Compensating Clients for Mistakes of their Lawyers

All attorneys are obligated to provide legal representation to their clients which meets a minimum standard of care. When an attorney does something, or neglects to do something, that violates this standard of care, then the attorney has committed malpractice.

However, not all acts of legal malpractice warrant compensation to the damaged client. It must be shown that, if the neglectful attorney had, indeed, provided legal service that satisfied the standard of care, the client would have realized a different result.

Furthermore, under Virginia law, a client who has been damaged by his or her attorney’s malpractice will only be compensated for actual monetary losses caused by such malpractice. A client cannot recover for such subjective losses as mental anguish, emotional distress, inconvenience or pain and suffering.
